SECTION 1 – GENERAL PROVISIONS
Our Privacy Policy defines the terms of confidentiality when using the websites ecoclubrivne.org and money.ecoclubrivne.org, uaenergycoop.com, adapterra.org.ua (hereinafter collectively referred to as the “Website“), the general rules for collecting, processing, transferring, using, and storing the personal data of the Website user by the Website Owner.
We comply with all legal requirements to protect your privacy. Our Privacy Policy is a legal document that explains what information about you we will collect when you use the Website, how this information will be used, and how we will transfer and protect this information.
EACH USER MUST CAREFULLY READ AND COMPLY WITH THIS PRIVACY POLICY.
BY USING THE WEBSITE, YOU AGREE TO THE TERMS OF OUR PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY IN WHOLE AND/OR WITH RESPECT TO ITS INDIVIDUAL PROVISIONS, YOU MUST REFRAIN FROM USING THE WEBSITE. YOU ALSO AGREE THAT YOUR PERSONAL DATA THAT WE COLLECT IS PROCESSED WITH YOUR CONSENT.
You grant and guarantee us the right to process your personal data, including the right to perform the following actions for processing your personal data (fully or partially in an automated system): storage, registration, modification, recovery, and deletion. You also agree that your personal data is included in our personal data database and no additional notifications in this regard are required.
SECTION 2 – DEFINITIONS
2.1. In this Privacy Policy, the following terms have the meanings specified below in this Section:
2.1.1. “Website” means the website ecoclubrivne.org and/or all its subdomains, including money.ecoclubrivne.org, uaenergycoop.com, and the website adapterra.org.ua. The Website provides Users with the ability to use the Website’s features, including receiving email notifications (newsletters) and registering for online courses.
2.1.2. “User” (“Users”) means an individual who visits and/or uses the Website and/or otherwise has access to the Website’s features.
2.1.3. “Personal Information” (“Personal Information” or “Personal Data”) means any information that can be directly linked to a specific individual and can be used to identify them (including information about your actions, for example, information about your use of the Website, when it is directly linked to personal information). We do not consider Personal Data to include information that has been anonymized and does not allow identification of a specific User.
2.1.4. “Controller” means the person who determines the purposes and methods of processing personal data.
2.1.5. “Processor” means the person who processes personal data on behalf of the Controller.
2.1.6. “Owner” (“Website Owner”) or “we” (“us”, “our”) means PUBLIC ORGANIZATION “ECOCLUB”, which owns the exclusive rights to the intellectual property object – the Website. PUBLIC ORGANIZATION “ECOCLUB” is registered in accordance with the legislation of Ukraine (address: Ukraine, 33024, Rivne, Soborna Street, building 259, apartment 84).
2.1.6.1. The Website Owner is also the person who determines the purposes and methods of processing personal data, as well as processes personal data. Accordingly, the Website Owner is the Controller and Processor within the meaning specified in clauses 2.1.4. and 2.1.5. of this Privacy Policy. However, there may also be another person who processes personal data on behalf of the Website Owner (as Controller).
2.2. Other terms and definitions used in this Privacy Policy should be understood in accordance with the terms of use of the Website (if any), unless otherwise specified in this Privacy Policy.
SECTION 3 – INFORMATION WE COLLECT AND PROCESS
3.1. The User agrees to provide us, immediately upon receipt of our request, with any information (including Personal Data) that we deem necessary to obtain in order to comply with the requirements of any law and/or regulatory legal act and/or court decision.
3.2. The technical (software) means of the Website may collect the following Personal Data: email, first name, last name. As a user, you provide us with your voluntary and unconditional consent to the collection and processing of the specified Personal Data and their transfer to third parties for the purpose of ensuring the functioning of the Website (ensuring the performance of its functions).
3.3. The above information and documentation described in clause 3.2. may be requested or collected by us before activating an account on the Website or providing any services available through the Website. Any doubts about the accuracy and authenticity of the information you provide may be considered a valid reason for refusing access to the Website and/or its respective features.
3.4. You, as a user, agree, represent, and warrant that all information provided to us is current, complete, and accurate.
3.5. Data collected from all users, including unregistered users. We collect data about the use of the Website and use the information you provide, sent from your computer, mobile phone, or other device, which may include your IP address, device information, including but not limited to identifier, name and type of operating system, mobile network information, standard web log information such as your browser type and the pages you accessed on our website. You, as a user, provide us with your voluntary and unconditional consent to the collection and processing of the specified data and their transfer to third parties to ensure the functioning of the Website and its proper operation.
3.6. We also store and process user requests to our support service.
3.7. When you use the Website, we (or Google Analytics or a similar service provider on our behalf) may place small data files, cookies, on your computer or other device. We use these technologies to identify you as a user of the site; customize our website or advertising; measure the effectiveness of advertising; collect information about your computer or other device from which the Website is accessed to reduce risks, help prevent fraud, and increase trust and security.
3.7.1. Most browsers are set to accept cookies by default. You can control the use of cookies in your internet browser settings. You should refer to your browser’s instructions, for example, the “Help” section or a similar section, to learn more about how to manage cookies and how to configure your browser to refuse all cookies. However, if you do not accept cookies, some pages on our website may display incorrectly, and some features may not work properly. 3.8. YOU AGREE THAT YOUR PERSONAL DATA MAY BE PROCESSED AND STORED BY US AND/OR OUR CONTRACTORS FOR THE TIME NECESSARY TO PERFORM THE TASKS ARISING FROM THE FUNCTIONAL PURPOSE OF THE WEBSITE.
SECTION 4 – HOW WE USE YOUR INFORMATION
We use the information received from you in the following manner and for the following purposes.
4.1. We collect only the user data that is necessary for the proper use of the Website and the proper implementation of the Website’s functions. We use your personal data to:
- implement the Website’s functions;
- administer our Website and/or provide you with services;
- personalize the Website for you;
- inform you about the activities of PO “ECOCLUB”;
- send you technical notifications, support service notifications, and administrative notifications;
- inform you about the services, promotions, and events of PO “ECOCLUB”;
- track and analyze the use and actions related to the Website;
- provide third parties with statistical information about our users (but these third parties will not be able to identify any individual user from this information);
- verify compliance with the terms of use of the Website.
4.2. The Website Owner is the sole Controller and Processor of data, except in cases where there is an objective need for the Website Owner to process and/or store information with the Website Owner’s contractors.
SECTION 5 – PROTECTION AND STORAGE OF PERSONAL DATA
5.1. The Website Owner will make every effort and perform all actions defined by law to ensure limited access to any of your Personal Data, including but not limited to firewalls and data encryption, physical access control to our data processing centers and information access authorization, control measures (designed in accordance with applicable law), authorization of access to Personal Data only for those employees or contractors who need it to perform their respective duties.
5.2. The personal data of our users is stored and processed in Ukraine. However, your personal data may be temporarily stored and processed in other jurisdictions.
5.3. We reserve the right to store, process, and transfer your personal data to our servers in various jurisdictions where our infrastructure facilities and/or our contractors are located. Personal data may also be processed by employees working for us and/or for one of our service providers. Staff may participate in providing our services and/or processing your data and/or providing support. By submitting your personal data, you agree to this transfer, storage, and/or processing. We will ensure all reasonable measures necessary for the secure handling of your personal data.
SECTION 6 – THIRD PARTIES
6.1. We may transfer your personal information to:
- service providers (under contracts) who assist us with the implementation of certain areas of activity;
- our banking partners;
- organizations with which we plan to merge (in the event of such a merger, we will require the successor to comply with the terms of this Privacy Policy regarding your Personal Data);
- law enforcement agencies, government officials, and/or other third parties when we are required to transfer personal data in accordance with a decision of a competent authority and/or court; or we believe in good faith that disclosure of personal data is necessary to prevent physical harm and/or financial loss, to report suspected illegal activity;
- our partners and/or contractors cooperating with us and/or hired by us, whose services we need from a practical point of view;
- other persons – 1) only with your prior consent or 2) at your direction.
SECTION 7 – SERVICE INTEGRATION AND LINKS TO OTHER SITES
7.1. Our Website may contain links to the websites and/or mobile applications of our partners and advertisers (including but not limited to websites where our Website is advertised). If you follow a link to any of these websites and/or mobile applications, please note that these websites and any services that may be available through them have their own privacy policies, and that we are not responsible for these policies and/or any personal data that may be collected through these websites and/or services. Please review these policies before submitting any personal data to such websites and/or using such services.
SECTION 8 – PROTECTION OF MINORS’ PRIVACY
8.1. Our Website is not intended for use by persons under 16 years of age. If you are under 16 years of age, you should refrain from using the Website. If you are a parent or guardian and believe that your child (a person under 16 years of age) is using the Website, contact us to delete the child’s account. We reserve the right to obtain confirmation from you of your relationship with the child before we fulfill such a request. Also, please note that you are legally responsible for any actions of your child.
8.2. Some features of the Website may be available only to those persons who have reached the age of full legal capacity.
SECTION 9 – PERSONAL DATA RETENTION PERIOD
9.1. In accordance with the requirements of applicable law and, as necessary, to provide you with services, we may store your Personal Data. This need is due to the necessity to comply with legal obligations and resolve possible disputes. We may store your Personal Data as long as your account is active. Moreover, your Personal Data may be stored beyond the specified period as long as we need to have the relevant data to fulfill obligations that may arise later.

10.1. We use relevant and up-to-date electronic and organizational security measures to protect the information you provide from loss, misuse, disclosure, alteration, and destruction.
10.2. PLEASE NOTE THAT THE TRANSMISSION OF PERSONAL DATA OR INFORMATION (INCLUDING VIA EMAIL) OVER THE INTERNET AND OTHER PUBLICLY ACCESSIBLE NETWORKS IS NOT ABSOLUTELY SECURE.
SECTION 11 – ADDITIONS AND CHANGES
11.1. We reserve the right to change and/or supplement this Privacy Policy at any time. You should regularly review this Privacy Policy and familiarize yourself with it. By continuing to use the Website, you agree to all additions, changes, and updates to the Privacy Policy.
SECTION 12 – YOUR RIGHTS AS A PERSONAL DATA SUBJECT
12.1. You, as a subject of Personal Data, have all rights in accordance with the provisions of General Data Protection Regulation (EU) 2016/679. You agree that the manner of exercising your rights is governed by the terms of this Privacy Policy. The following clauses (12.3. and 12.4.) explain the manner of exercising some of your rights in accordance with the provisions of the General Data Protection Regulation.
12.2. WE TAKE ALL MEASURES TO COMPLY WITH GDPR REQUIREMENTS, HOWEVER, YOU, AS A USER, MUST TAKE INTO ACCOUNT THAT THE RELATIONSHIP BETWEEN YOU AND US IS GOVERNED, FIRST AND FOREMOST, BY THE LEGISLATION OF UKRAINE, IN PARTICULAR THE LAW OF UKRAINE “ON PERSONAL DATA PROTECTION”.
12.3. RIGHT OF ACCESS TO PERSONAL DATA
You have the right to access your personal information. To view your Personal Data that we have stored, as well as to make corrections to your Personal Data, you can request access to information or make corrections by writing to us at the email address specified in the “Contact Information” section below. If Personal Data is unavailable or changed, we will inform you of the reasons for this.
If you are a resident of a European Union member country, you have the right to:
• Access, update, or delete information about you that we store;
• Correct your information if it is inaccurate or incomplete;
• Object to our processing of your personal data;
• Restrict the processing of your personal data;
• Obtain a copy of your Personal Data in a structured format;
• Withdraw your consent at any time.
Please note that we may ask you to confirm your identity before responding to such requests. In addition, if you withdraw your consent to the processing of your Personal Data, we will not be able to provide you with our Services.
You also have the right to file a complaint with the competent personal data protection authority regarding the manner in which we collect and use your personal data. For more information, contact your local data protection authority in the European Economic Area (EEA). However, we recommend that you contact us first to resolve all your questions and requests to the extent permitted by law.
12.4. DELETION OF PERSONAL DATA
You have the right to request the correction or deletion of your personal data. You can exercise this right by sending us an email at office@ecoclubrivne.org. You may also withdraw your consent to the processing of Personal Data at any time.
If you withdraw your consent to the processing of Personal Data and we do not have legal grounds to continue processing your data, we will cease processing your Personal Data. If we have legal grounds to continue processing your data, we have the right to continue processing your Personal Data to the extent permitted by law.
Please note that we may retain some or all of the User’s data and not delete it until all our obligations related to the User’s Personal Data are fulfilled (for example, regarding the provision of services, fraud prevention, compliance with tax legislation, and fulfillment of other legal obligations, etc.). If we delete any information created by the user, including Personal Data, this information will be deleted from the active database, but it may remain in our archives. At the same time, the “archived version” is not intended for use as a backup copy.
